TOPIC: IMPLEMENTATION OF INTERNATIONAL LAW: GLOBAL AND REGIONAL TRADE RULES INCLUDING COMPETITION LAW

Treaties and other rules of International Law are not self-enforcing; their implementation is, generally speaking, reliant upon State mechanisms and institutions.

Implementation of the rules governing global and regional trade is particularly important given that Caribbean States have accepted that the multilateral trading systems is catalytic to economic growth and development. CARICOM States are members of the WTO and of the CSME created by the Revised Treaty of Chaguaramas, “in order to achieve sustained economic development based on international competitiveness, coordinated economic and foreign policies, functional co-operation and enhanced trade and economic relations with third states.”

Notwithstanding, implementation of International Law rules has been and remains among the most challenging juridical issues facing the global community. There is a basic divide between so-called “monist” and “dualist” states but there are also important divisions and variations between and among these states in terms of the interpenetration of International Law. The actual rules on implementation applicable within a given country may depend more on the constitutional and legislative landscape than on any generalized notion of the interface between national and International Law.

The CCJ’s Third Biennial CALCA Seminar on Law considers the Implementation of Rules on International and Regional Trade against the broad backdrop of the application of International Law.

The Seminar proposes to discuss:

  • Application of the doctrines of Monism and Dualism
  • Implementation of International Law in the Common Law and Civil Law countries
  • The International Courts Project
  • The roles of International Courts such as ICJ; ECJ; ECtHR; IACtHR; ECOWAS; MERCUSOR in implementation of International Law
  • Application and legal interpretation given to the WTO Agreements by the WTO Dispute Settlement Panels and by the Appellate Body
  • The impact of CSME law and jurisprudence
  • The Caribbean Court of Justice in the enforcement of International Trade Law

This seminar will feature and be facilitated by eminent experts from the Europe, North America and the Caribbean and will be conducted in an intensive manner, engaging participants through presentations, discussions and practical exercises. Participants will have electronic access to study materials. A certificate of participation will be awarded upon successful completion of the Seminar.
